Your request on our website or any other written or verbal request does not constitute a binding request. Our partner reserves the right to reject requests due to insufficient creditworthiness. e-FRAMER products (hereinafter referred to as “products”) are delivered by us fully prepared, ready to ride and tested by a specialist to the desired address within Switzerland and Liechtenstein. Delivery of the order is free of charge. <\/p>\n

In the event of a warranty claim, you are obliged to contact e-FRAMER in advance so that the existence of a warranty case can be checked in accordance with our warranty provisions.<\/p>\n

6. terms of payment<\/strong><\/p>\n

In addition to payment on delivery, direct transfer, payment by installments, various credit cards, debit cards, Twint and invoices are also accepted as means of payment.
\nWe reserve the right not to offer certain payment options for each order and to refer to our other payment options. Any offsetting of your claim against the payment claim of e-FRAMER is excluded. Please note that we can only accept payments in CHF (Swiss francs) and from accounts within the European Union (EU), Liechtenstein and Switzerland. Purchase on account, payment in 3 installments<\/p>\n

For certain offers, the customer may be offered the payment method purchase on account or payment by installments. In this case, payment processing will be carried out in cooperation with an external partner who will carry out an identity and credit check on the customer and, after conclusion of the contract between e-FRAMER and the customer, will take over the invoice claim and be responsible for payment processing and any debt collection proceedings. e-FRAMER will remain responsible for all matters relating to the contract with the customer, with the exception of payment processing and any dunning and debt collection proceedings. Upon expiry of the payment deadline, the customer shall be in default without further reminder (Art. 102 para. 2 CO). The customer may be charged reminder fees and the costs of any collection proceedings. A breach of the payment obligation may result in the payment method purchase on account no longer being offered for future online orders of goods, even by merchants other than e-FRAMER. <\/p>\n

7. delivery<\/h3>\n

The product is delivered personally to the destination address by our specialist. The product is also installed by the specialist. Public access for trucks is a prerequisite. In the event of delays in delivery, the customer will be informed by e-FRAMER as soon as possible. <\/p>\n

You will be charged for subsequent costs in the following situations. In addition, e-FRAMER is entitled to terminate the contract if: <\/p>\n

The goods cannot be handed over to you for reasons for which you are responsible (e.g. incorrect or incomplete addressing, refusal to accept the goods without a justified reason, etc.).
\nA product ordered at the point of sale is not collected within 14 calendar days of being ready for collection.<\/p>\n

8. reservation of title<\/h3>\n

The delivered goods shall remain our property until the purchase price and the associated costs have been paid in full. If the legal requirements are met, we reserve the right to make a corresponding entry in the retention of title register. <\/p>\n

9. returns<\/h3>\n

The customer has a right of return of 30 days and less than 150 kilometers driven. Within this period, the customer has the right to test the product and withdraw from the contract. In the case of willfully damaged products, e-FRAMER reserves the right to refuse acceptance and to withdraw from the right of return. This does not apply to normal signs of use of the product within the scope of the 30-day right of return. If the right of return is granted, e-FRAMER will then arrange for the product to be collected from the place of delivery. If the product is found to be willfully damaged or soiled upon collection, e-FRAMER reserves the right to refuse acceptance and thus collection of the product. In this case, the 30-day right of return expires immediately and without revocation. <\/p>\n

Subject to a warranty claim, any right of return is excluded after expiry of the 30-day return period since delivery of the product.<\/p>\n

10. liability<\/h3>\n

Claims for damages by the customer are excluded to the extent permitted by law. This exclusion of liability applies to any kind of breach of duty by e-FRAMER, its employees or dealers or a third party or parties engaged by them in connection with the contract concluded, irrespective of whether they are based on the contract concluded or on any other legal grounds. <\/p>\n

e-FRAMER endeavors to observe the copyrights of the images, graphics, sound documents, video sequences and texts used in all publications, to use images, graphics, sound documents, video sequences and texts it has created itself or to make use of license-free graphics, sound documents, video sequences and texts. All brands and trademarks mentioned on the website and possibly protected by third parties are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the respective registered owners. The mere mention of a trademark does not imply that it is not protected by third-party rights. The copyright for published objects created by e-FRAMER itself remains solely with e-FRAMER. Reproduction or use of such graphics, sound documents, video sequences and texts in other electronic or printed publications is not permitted without the express consent of e-FRAMER. <\/p>\n

14 Applicable law<\/h3>\n

The contractual relationship between the customer and e-FRAMER shall be governed exclusively by Swiss law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).<\/p>\n

15. place of jurisdiction<\/h3>\n

Disputes and disagreements arising from or in connection with the agreement concluded between the parties, including its validity, invalidity, breach or termination, shall be judged exclusively by the ordinary courts at the registered office of Ochsner Sport AG.<\/p>\n

1. duration<\/h3>\n

Ochsner Sport AG (hereinafter referred to as e-FRAMER or we) assumes, unless otherwise stated on the product or on the invoice, for at least 4 years from the date of purchase or collection or home delivery from 01.01.2023, the warranty within the scope of validity for the freedom from defects and functionality of the object of purchase, compliance with the legal requirements and\/or the products replaced under warranty. For e-bikes purchased by 31.12.2022, the warranty period concluded at the time of purchase is 2 years. <\/p>\n

2. performance<\/h3>\n

e-FRAMER is entitled to provide the warranty service either by free repair, equivalent replacement, price reduction or by reimbursement of the product price at the current market\/time value<\/p>\n

3. disclaimer<\/h3>\n

The warranty does not cover the replacement of parts that are subject to natural wear and tear (e.g. tires, tubes, chains, sprockets, brake pads, paintwork, labels). It is the responsibility of the end customer to regularly maintain and care for the e-FRAMER e-Bike (including carrying out all inspections in accordance with the operating instructions). <\/p>\n

e-FRAMER is also not liable for damage caused by the actions of third parties, atmospheric discharges, overvoltage, external influences and chemical influences.<\/p>\n

Also excluded from the warranty are such defects which arise from arrangement and assembly not effected by e-FRAMER, inadequate equipment, non-observance of the installation requirements and conditions of use, overloading of the parts, misuse, negligent or incorrect handling and use of unsuitable materials; this also applies to defects which are attributable to material provided by the buyer.<\/p>\n

4. discontinuation of the warranty<\/h3>\n

The warranty expires immediately if the customer himself or a third party not expressly authorized by e-FRAMER makes changes or repairs to the delivered items without the written consent of e-FRAMER, in particular if the product has been modified or repaired or has not been used as intended (e.g. racing and competition use, commercial use, overloading and other use outside the intended purpose): Racing and competition use, commercial use, overloading and further use outside the intended purpose).<\/p>\n

5. assumption of costs<\/h3>\n

Within the warranty period, e-FRAMER will cover the costs of repairs or replacements due to defects, provided that these are carried out by a specialist dealer recognized by e-FRAMER after clear identification of the product (proof of purchase, completed e-bike passport or corresponding registration). The warranty continues to apply in the event of sale to a third party, provided that the buyer is also resident in Switzerland. e-FRAMER reserves the right to supply or install functionally equivalent goods when replacing a product or components under warranty. <\/p>\n

The battery is replaced 100% in the first two years from the date of purchase. In the 3rd year, 50% of the procurement costs of a battery of the same type and quality and in the 4th year, 25% of the procurement costs of a battery of the same type and quality. <\/p>\n

6. assessment<\/h3>\n

The e-FRAMER specialist staff will conclusively assess whether the claimed damage constitutes a defect covered by the warranty or whether the defect has occurred due to wear and tear or other reasons excluded from the warranty. This assessment defines e-FRAMER’s warranty obligation. <\/p>\n

7. utilization<\/h3>\n

The warranty only applies if the insured bike was purchased in Switzerland or the Principality of Liechtenstein and the buyer is resident in Switzerland.<\/p>\n

The use of the warranty does not lead to an extension of the original warranty period. This shall continue for the original period. <\/p>\n
